xoomi.ai provides an AI-powered sales agent platform for e-commerce stores. The Service includes chat widget integration, product recommendations, analytics, and related features as described on our website.

  • You are responsible for all applicable taxes
  • Failed payments may result in service suspension

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. By using the Service, you grant us a license to process your data as necessary to provide the Service.

7. AI-Generated Content Disclaimer

IMPORTANT: The Service uses artificial intelligence and machine learning technologies to generate responses, product recommendations, and customer interactions. By using this Service, you expressly acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, omissions, or inappropriate responses despite our best efforts to ensure quality.
  • AI responses are generated automatically and may not reflect the views, policies, or intentions of your business.
  • You are solely responsible for reviewing, monitoring, and verifying all AI-generated content before and during its use with your customers.
  • You must implement appropriate safeguards and human oversight for AI interactions, particularly for sensitive or high-stakes communications.
  • xoomi.ai provides the AI Service on an "as is" and "as available" basis without any warranties, express or implied, regarding accuracy, reliability, or fitness for any particular purpose.
  • xoomi.ai shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from AI-generated content, including but not limited to loss of revenue, reputation damage, customer complaints, or legal claims.
  • You agree to indemnify and hold harmless xoomi.ai from any claims, damages, or expenses arising from your use of AI-generated content or your failure to adequately supervise AI interactions.

By subscribing to and using the Service, you acknowledge that you have read, understood, and agree to these AI-related terms and accept full responsibility for the use of AI-generated content in your business operations.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by xoomi.ai and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

9. Third-Party Integrations

The Service integrates with third-party platforms (e.g., Shopify, WooCommerce). Your use of these platforms is governed by their respective terms. We are not responsible for third-party services.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Scheduled maintenance will be communicated in advance when possible.

11. Limitation of Liability

To the maximum extent permitted by law, xoomi.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

12. Indemnification

You agree to indemnify and hold harmless xoomi.ai from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will be revoked
  • You may request export of your data within 30 days
  • We will delete your data according to our retention policy

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of New South Wales, Australia.
